OVERVIEW
Welcome to Play Fair! These Terms of Service and Festival Attendance Terms (together, these "Terms") govern your use of our website and online store at https://findplay.co (the "Store"), as well as your purchase of tickets, merchandise, and vendor or activation spots, and your attendance at any Play Fair event (each an "Event").
The terms "we", "us" and "our" refer to Play Fair. The terms "you" and "your" refer to you, the customer, attendee, vendor, or community partner using our Store or attending our Events.
Our Store is powered by Shopify. By purchasing through our Store, you acknowledge that Shopify enables the technical infrastructure for our store but that all sales, purchases, and transactions are made directly with Play Fair. Shopify is not responsible for any aspect of those transactions.
These Terms are organised into two parts:
• Part A — Store Terms: applies to your use of our website and online store, including purchases of tickets, merchandise, and vendor or activation spots.
• Part B — Festival Attendance Terms: applies to your physical attendance at any Play Fair Event.
Please read these Terms carefully. By visiting or using our Store, or by attending an Event, you agree to be bound by them. If you do not agree, you should not use our Store or attend our Events.

PART A — STORE TERMS

SECTION 1 — ACCESS & ACCOUNT
By agreeing to these Terms, you confirm that you are at least the age of majority in your country or region of residence. If you are purchasing on behalf of a minor, you confirm that you have the legal authority to do so.
To purchase tickets, merchandise, or vendor/activation spots through our Store, you may be asked to provide personal, billing, payment, and shipping information. You confirm that all information you provide is accurate, current, and complete, and that you have the right to provide it.
You are solely responsible for maintaining the security of any account credentials and for all activity that occurs under your account. You may not transfer, sell, or assign your account to any other person.
SECTION 2 — OUR PRODUCTS & SERVICES
We sell the following through our Store:
• Event Tickets — admission to Play Fair events
• Merchandise — branded and curated physical products
• Vendor Spots — bookable spaces for commercial brand or second-hand sellers at Events
• Activation Slots — bookable participation spots for community groups, clubs, and organisations
We make every effort to accurately represent all products and services in our Store. However, colours, dimensions, and appearance may vary from on-screen representations depending on your device settings. We do not warrant that any product or service will meet your expectations in every respect.
All product descriptions, prices, and availability are subject to change at any time without notice. We reserve the right to limit quantities, discontinue any product or service, or decline to fulfil any order at our discretion.
SECTION 3 — ORDERS
When you place an order through our Store, you are making an offer to purchase. Play Fair reserves the right to accept or decline any order for any reason. Your order is not accepted until we confirm acceptance and have successfully processed your payment.
Please review your order carefully before submitting it. Once an order is accepted, we may be unable to accommodate cancellation requests. In the event we decline, modify, or cancel an order, we will contact you using the details you provided at checkout.
Returns and exchanges are governed by our Refund Policy. Please review it carefully before purchasing. Note that Event Tickets and Vendor/Activation Spots are subject to their own specific cancellation terms set out below.
You confirm that all purchases are for your own personal or business use and not for unauthorised commercial resale or export.
SECTION 4 — TICKETS
Purchasing Tickets
Event Tickets purchased through our Store grant the named purchaser (and any invited guests specified at the time of purchase) a revocable licence to attend the relevant Event, subject to the Festival Attendance Terms in Part B of these Terms.
Tickets are non-transferable and may not be resold, gifted to a third party for commercial gain, or listed on secondary ticketing platforms without our prior written consent. Tickets obtained from unauthorised sources may be invalid and will be refused at entry without refund.
Ticket Cancellation & Refunds
Tickets are non-refundable except as required by applicable law, or in the event that:
• The Event is cancelled by Play Fair and is not rescheduled; or
• The Event is significantly altered in a way that materially affects the nature of what was purchased.
In the event of a cancellation or postponement, we will communicate our refund or exchange policy via our website and ticketing platform. Where an Event is cancelled or curtailed due to circumstances beyond our reasonable control (including but not limited to adverse weather, government restrictions, public health emergencies, or venue unavailability), refunds will be offered at our discretion and in compliance with applicable consumer law.
If you are denied entry to or removed from an Event due to a breach of these Terms or the Festival Attendance Terms, no refund will be issued.
SECTION 5 — MERCHANDISE
Merchandise purchased through our Store is subject to our standard Refund Policy. We aim to despatch all orders within a reasonable number of business days of payment confirmation.
Shipping & Delivery
All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer your order to the carrier, title and risk of loss passes to you.
Shipping costs and any applicable customs or import charges will be displayed at checkout. Unless otherwise stated, posted prices do not include shipping costs or applicable taxes.
SECTION 6 — VENDOR SPOTS & ACTIVATION SLOTS
Vendor Spots
Vendor Spots are bookable spaces at Play Fair Events available to commercial brands and second-hand sellers. By purchasing a Vendor Spot, you agree to the following:
• You are solely responsible for all goods, services, and conduct at your stand or space.
• You must comply with all applicable trading, consumer protection, health and safety, and tax laws.
• You must hold any licences, permits, or insurance required to trade at the Event.
• You may only sell goods or services that have been approved by Play Fair in advance. We reserve the right to refuse or remove any goods or services we deem inappropriate.
• Your space, signage, and materials must comply with the guidelines communicated to you at the time of booking.
• Play Fair is not a party to any transaction between Vendors and Event attendees and accepts no liability for such transactions.
Vendor Spot bookings are non-refundable within 14 days of the Event. Cancellations made before this period may be eligible for a partial refund or credit at our discretion.
Activation Slots
Activation Slots are bookable spaces available to community groups, clubs, and organisations (such as art collectives, run clubs, or sports groups) wishing to host an activation at an Event. By booking an Activation Slot, you agree to the following:
• You are responsible for the safety, conduct, and content of your activation.
• Your activation must be suitable for a general community audience and must not involve any illegal, dangerous, or discriminatory activity.
• You must carry any necessary public liability insurance and comply with all applicable health and safety requirements.
• Any participation by Event attendees in your activation is voluntary. You must make this clear and obtain any appropriate consent from participants.
• Play Fair is not responsible for any injury, loss, or damage arising from participation in or proximity to your activation.
If you are a not-for-profit community group, please contact us at hello@findplay.co — we may be able to offer reduced or complimentary slots depending on availability.
SECTION 7 — PRICES & BILLING
Prices for all products and services are displayed in the applicable currency and are subject to change without notice. The price charged will be the price confirmed at the time your order is accepted. Unless otherwise stated, prices do not include taxes, shipping, handling, customs, or import charges.
We may offer promotional pricing from time to time. Promotions are subject to their own terms and availability. In the event of a conflict between promotion terms and these Terms, the promotion terms will govern.
By submitting a payment, you confirm that: (i) your payment information is accurate and complete; (ii) you are authorised to use the payment method provided; (iii) charges will be honoured by your card or payment provider; and (iv) you will pay all amounts due including any applicable taxes and fees.
SECTION 8 — INTELLECTUAL PROPERTY
All content on our Store, including but not limited to our name, logos, branding, text, images, graphics, video, and audio (collectively, "Festival IP"), is owned by or licensed to Play Fair and is protected by applicable intellectual property laws.
You may use our Store for personal, non-commercial purposes only. You may not reproduce, distribute, modify, display, or commercially exploit any Festival IP without our prior written consent.
Community Partners and Vendors retain ownership of their own intellectual property. Play Fair makes no claim over the intellectual property of Community Partners or Vendors.
SECTION 9 — FEEDBACK & USER CONTENT
If you submit any feedback, reviews, suggestions, or other content to us ("Feedback"), you grant Play Fair a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and display that Feedback for any purpose, including to promote the Event and our Store.
You confirm that: (i) you own or have the right to submit all Feedback; (ii) your Feedback is accurate and does not infringe any third-party rights; and (iii) your Feedback does not contain unlawful, offensive, or harmful content. We may remove Feedback at our sole discretion.
SECTION 10 — THIRD-PARTY LINKS & TOOLS
Our Store may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party site. Accessing third-party links is at your own risk.
Our Store may also offer access to optional third-party tools. These are provided "as is" without any warranty or endorsement from us. Your use of such tools is subject to the third party's own terms and conditions.
SECTION 11 — RELATIONSHIP WITH SHOPIFY
Note: This section accurately describes Shopify's role and should not be removed.
Our Store is powered by Shopify. However, all sales and purchases are made directly with Play Fair. Shopify is not responsible for any aspect of any transaction between you and Play Fair, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims arising from your transactions with Play Fair.
SECTION 12 — PRIVACY
All personal information collected through our Store is handled in accordance with our Privacy Policy, and certain data may also be subject to Shopify's Privacy Policy as our hosting provider. By using our Store, you confirm that you have read and understood both policies.
SECTION 13 — ERRORS & INACCURACIES
Occasionally our Store may contain typographical errors, pricing inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time without prior notice, including after an order has been submitted. In the event of a pricing error, we will contact you before processing your order.
SECTION 14 — PROHIBITED USES
You may use our Store for lawful purposes only. You may not use our Store to:
• Engage in any unlawful, fraudulent, or harmful activity
• Infringe our intellectual property rights or the rights of any third party
• Transmit spam, malware, or other malicious code
• Impersonate any person or entity
• Collect or harvest personal data of other users without consent
• Resell, duplicate, or commercially exploit any part of our Store without our written consent
• Use automated tools, bots, scrapers, or AI agents to access or interact with our Store without our prior written consent
We reserve the right to suspend or terminate your access to our Store at any time without notice if we determine you have violated any part of these Terms.
SECTION 15 — AUTOMATED AGENTS
If you use, allow, or deploy any automated software or AI agent ("Agent") to access or interact with our Store, the following requirements apply:
• The Agent must identify itself in all HTTP/HTTPS requests by including "Agent/[agent name]" in its user agent string.
• The Agent must not conceal or misrepresent that interactions are automated, including by mimicking human behaviour or bypassing CAPTCHA or verification measures.
• The Agent must respond truthfully to any prompt seeking to determine whether interactions are from a human or a computer.
• The Agent must not circumvent any technical measures we employ to limit automated access.
We may restrict or block automated access to our Store at any time. Agents that have been asked to refrain from accessing our Store must comply immediately.
SECTION 16 — DISCLAIMER OF WARRANTIES
Our Store and all products and services offered through it are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our Store will be uninterrupted, error-free, or free from viruses or other harmful components. Some jurisdictions do not permit the exclusion of implied warranties, so the above may not apply to you in full.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLAY FAIR, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS (INCLUDING SHOPIFY AND ITS AFFILIATES) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF OUR STORE, YOUR ATTENDANCE AT ANY EVENT, OR YOUR PURCHASE OF ANY PRODUCTS OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
SECTION 18 — INDEMNIFICATION
You agree to indemnify and hold harmless Play Fair, its affiliates, directors, officers, employees, agents, and service providers from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any applicable law or third-party rights; or (3) your use of our Store or attendance at any Event.
SECTION 19 — TERMINATION
We may terminate or suspend your access to our Store at any time and without notice if we determine that you have breached these Terms. Sections 8 (Intellectual Property), 9 (Feedback), 17 (Limitation of Liability), 18 (Indemnification), and any provisions that by their nature should survive termination, will continue to apply after termination.
SECTION 20 — GENERAL PROVISIONS
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining Terms shall continue in full force.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Play Fair with respect to your use of our Store and attendance at Events, and supersede all prior agreements and communications.
Assignment
You may not transfer or assign these Terms or any of your rights under them without our prior written consent. We may assign or transfer these Terms without restriction.
SECTION 21 — GOVERNING LAW
These Terms are governed by and construed in accordance with the following laws, depending on where you are located:
• If you are located in the United Kingdom or the European Economic Area: these Terms are governed by the laws of England and Wales, and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
• If you are located in the United States or elsewhere: these Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions, and you agree to submit to the non-exclusive jurisdiction of the state and federal courts located in New York County, New York.
Nothing in this section affects your rights under mandatory consumer protection laws applicable in your country of residence.
SECTION 22 — CHANGES TO THESE TERMS
We reserve the right to update or change these Terms at any time. The most current version will always be available on our website. We will notify you of any material changes in accordance with applicable law. Your continued use of our Store or attendance at any Event following a change constitutes your acceptance of the updated Terms.

PART B — FESTIVAL ATTENDANCE TERMS

These Festival Attendance Terms apply to all persons who attend a Play Fair Event, whether or not they purchased their ticket through our Store. By entering an Event, every attendee agrees to be bound by these terms.
These Attendance Terms supplement the Store Terms in Part A. In the event of a conflict between Part A and Part B, Part B will govern with respect to matters relating to physical Event attendance.
B1 — TICKETS & ENTRY
All tickets, wristbands, passes, and authorisations issued for an Event (collectively, "Tickets") are subject to these Terms. Tickets constitute a revocable licence to enter the Event venue, granted solely at Play Fair's discretion.
By presenting a Ticket at the Event, the bearer confirms they have read and accepted these Terms in full. Play Fair reserves the right to refuse entry or remove any person from the Event at any time, including where these Terms have been breached, without refund.
Unauthorised Transfers
Tickets may not be resold for commercial gain, transferred for value, or listed on any secondary ticketing platform without our prior written consent. Tickets obtained from unauthorised sources may be invalid and will be refused at entry without refund. Resale or attempted resale of Tickets above face value is grounds for immediate revocation without refund.
Admission & Entry Requirements
All attendees must comply with any entry requirements communicated via our website or by Event staff, including age restrictions, ID requirements, and health and safety protocols. Entry requirements may change without prior notice.
Consent to Search
As a condition of entry, attendees, their vehicles, and their belongings may be searched by authorised Event staff or security. By entering the Event, you consent to such searches. Refusal may result in denial of entry without refund.
B2 — PROHIBITED ITEMS & CONDUCT
The following items are prohibited at all Play Fair Events unless otherwise authorised in writing:
• Glass bottles or glass containers of any kind
• Weapons of any kind, including knives or any item that could cause harm
• Illegal substances or drug paraphernalia
• Flares, fireworks, or pyrotechnics
• Laser pointers
• Drones or any remotely operated aerial devices
• Large bags exceeding the dimensions specified on our website
• Animals (except registered assistance animals)
• Your own alcohol, unless specifically permitted by Play Fair in advance
• Any items that pose a safety risk or may disturb other attendees, at Event staff's discretion
Play Fair reserves the right to refuse admission to or remove any attendee whose conduct is, in the reasonable opinion of Event staff, disorderly, threatening, harmful to others, or in breach of these Terms. No refund will be issued in such circumstances.
B3 — ALCOHOL POLICY
Play Fair is a community-focused event. Events may take place at private venues where alcohol is present and may be sold or served by the venue operator or licensed third parties under their own licences. Play Fair does not sell, serve, supply, or distribute alcohol at Events.
Any alcohol available at an Event is provided solely by the venue or its licensed operators, who are solely responsible for compliance with applicable licensing laws. Play Fair accepts no liability for the sale, service, or consumption of alcohol at any venue.
Attendees must drink responsibly. Disorderly or aggressive behaviour resulting from intoxication may result in removal from the Event without refund. Play Fair reserves the right to refuse entry to or remove any person who appears to be excessively intoxicated.
B4 — COMMUNITY ACTIVATIONS, VENDORS & COMMERCIAL ACTIVITY
Community Activations
Events feature activations by independent community groups including art clubs, run clubs, sports clubs, and other organisations ("Community Partners"). These activations are independently operated. Play Fair is not responsible for the activities, conduct, or content of any Community Partner activation and does not accept liability for any loss, damage, or injury arising from participation in or proximity to a Community Partner activation.
Participation in any activation is entirely voluntary and at your own risk. Please read any participation guidelines provided by the relevant Community Partner before taking part.
Vendors & Second-Hand Sellers
Events include sales by approved commercial brands and second-hand vendors ("Vendors"). All Vendor transactions are conducted directly between Vendors and attendees. Play Fair is not a party to any such transaction and accepts no liability for the quality, safety, legality, or fitness for purpose of any goods or services sold by Vendors.
Unauthorised Commercial Activity
No attendee may conduct any commercial activity, sales, sampling, marketing, or distribution of promotional materials at an Event without Play Fair's prior written consent. Unauthorised commercial activity is grounds for immediate removal without refund.
B5 — PHOTOGRAPHY, VIDEO & RECORDING
Attendees may bring personal, non-commercial cameras and smartphones to Events and may capture photographs and short personal videos ("Personal Content") for non-commercial personal use.
The following require prior written consent from Play Fair:
• Professional or commercial photography or video equipment
• Cameras with detachable lenses
• Tripods, monopods, selfie sticks, or camera mounting accessories
• Live streaming, broadcasting, or public transmission of any audio or visual content from the Event
• Any device intended for commercial recording or broadcast purposes
Personal Content may be shared on your personal social media accounts for non-commercial purposes. Personal Content must not be used to advertise, endorse, or promote any product, brand, or service without Play Fair's prior written consent.
B6 — CONSENT TO USE OF IMAGE & LIKENESS
By entering an Event, each attendee grants Play Fair and its authorised agents the unrestricted right to capture, use, and reproduce their image, likeness, voice, actions, and statements in photographs, video, recordings, and any other media taken at or in connection with the Event, for any purpose including promotional and marketing use, without further notice or compensation.
If you do not wish to be photographed or filmed, please speak with an Event staff member on arrival. We will make reasonable efforts to accommodate requests but cannot guarantee that you will not appear incidentally in general crowd footage.
B7 — PROGRAMME & SCHEDULE
The Event programme — including artists, performers, activations, vendors, and scheduled times — is subject to change without notice. Play Fair does not guarantee the appearance of any particular performer, artist, or Community Partner. No refunds will be issued as a result of changes to the programme or schedule.
B8 — HEALTH, SAFETY & MEDICAL CONSENT
The safety and wellbeing of all attendees, staff, and Community Partners is a priority. All attendees must follow the reasonable instructions of Event staff and security personnel at all times.
By attending an Event, each attendee consents to receive any medical treatment that Event staff or emergency responders consider necessary in the event of injury, accident, or illness. Play Fair and its authorised representatives shall not be held responsible for any actions taken in good faith in the course of providing emergency assistance.
Attendees with existing medical conditions are encouraged to carry any necessary medication and to notify Event staff upon arrival if they may require assistance.
B9 — ASSUMPTION OF RISK & WAIVER
Attendees acknowledge that attending a community event involves inherent risks of personal injury and property damage, including risks arising from crowd activity, weather conditions, uneven terrain, participation in activations, and interaction with other attendees.
By purchasing or using a Ticket, each attendee voluntarily and knowingly assumes all such risks and agrees that Play Fair, its directors, officers, employees, volunteers, Community Partners, Vendors, and associated parties (collectively, "Released Parties") shall not be liable for any loss, injury, or damage arising out of or in connection with the Event, except to the extent caused by the gross negligence or wilful misconduct of the Released Parties.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
